# Privacy Policy — Cloud Therapy

This Privacy Policy explains how Cloud Therapy ("Cloud Therapy", "we", "us", or "our") collects, uses, and protects your information when you use the Cloud Therapy mobile app (the "App"). Cloud Therapy is provided by SOUTH SPHERE TECH PTY LTD ("SouthSphere", "the Company"), a company registered in South Africa.

## 1. Summary

- You can use Cloud Therapy as a guest, with no account, in which case your data stays on your device and is not sent to our servers.

- If you create an account (email, Google, or Apple), we store a small amount of data so your resets, streak, and settings sync across your devices.

- We do not sell your personal information, show third-party ads, or use third-party advertising or analytics trackers.

- Payments and subscriptions are handled by Apple; we never receive your card details.

- You can delete your account and all associated data from within the App at any time.

## 2. Information we collect

### 2.1 Information you provide

- Account information. If you sign up, we process your email address and a display name. If you sign in with Google or Apple, we receive your email and name from that provider (with Apple, this may be a private relay email). If you sign up with email and password, your password is hashed by our authentication provider before storage — we never see or store your plain password.

- Personalization details (optional). If you complete the in-app survey or set up routines, we store your answers (for example: how often you feel stressed, times of day you tend to feel anxious, your breathing goals) and any routines or work-schedule settings you configure.

### 2.2 Information created through your use of the App

- Reset history and progress. Records of the resets you complete (the mode, date, duration, and an optional mood check-in) used to show your Progress and Insights.

- App settings. Preferences such as reminder cadence, sound and haptic toggles, and selected soundscape.

- Subscription entitlement. If you subscribe, we store whether you have an active subscription, the product, and its expiry, linked to your account. This is derived from a purchase receipt that is cryptographically verified with Apple — you cannot be granted access without a genuine Apple transaction.

### 2.3 Information we do NOT collect

- We do not collect precise location, contacts, photos, health-kit data, or device advertising identifiers.

- We do not use third-party advertising or analytics SDKs.

- As a guest, none of the above is sent to us — it remains only on your device.

## 3. How we use your information

We use your information only to:

- Provide and sync the App's core features across your devices;

- Maintain your account and authenticate you;

- Deliver the reminders and routines you configure (via local notifications scheduled on your device);

- Determine your subscription/Premium access;

- Respond to your support requests;

- Keep the service secure and prevent abuse;

- Comply with legal obligations.

We rely on the following legal bases (where GDPR/UK GDPR applies): performance of a contract (providing the App you signed up for), your consent (optional personalization), and our legitimate interests (security and improving the service).

## 4. Where your data is stored and who processes it

Account and synced data are stored using Supabase, our backend and authentication provider, on infrastructure located in London, United Kingdom (EU/UK region). Depending on where you are located, your information may be transferred to and processed in a country different from your own; where required we rely on appropriate safeguards for such transfers.

Service providers (sub-processors) we use:

- Supabase — authentication, database, and hosting of your synced data (account + synced app data).

- Apple — Sign in with Apple, and App Store payments & subscriptions (we do not receive your payment details).

- Google — Sign in with Google, if you choose it (email and name from your Google account).

Data stored on your device is kept in the operating system's standard secure stores (UserDefaults and the Keychain) and is protected by your device's own security.

## 5. Sharing

We do not sell or rent your personal information. We share information only:

- with the service providers listed above, strictly to operate the App;

- if required by law, legal process, or to protect rights and safety;

- in connection with a business transfer (e.g. merger or acquisition), subject to this Policy.

## 6. Data retention

We retain your account and synced data for as long as your account exists. When you delete your account, we delete your account and its associated synced data (reset history, settings, personalization, and entitlement records). Backups and logs may persist for a limited period before being overwritten.

## 7. Your rights and choices

- Delete your account and data: In the App, go to Me → Delete account. This permanently removes your account and synced data.

- Use without an account: Choose "Continue without an account" to keep all data on your device.

- Depending on your location (e.g. EEA/UK under GDPR, or California under CCPA/CPRA), you may have rights to access, correct, delete, port, or restrict the processing of your personal data, and to object to certain processing. To exercise these, contact info@southsphere.global. We will not discriminate against you for exercising your rights.

- You can turn off notifications at any time in your device settings.

## 8. Children

Cloud Therapy is not directed to children under 13 (or the minimum age required in your country), and we do not knowingly collect personal information from them. If you believe a child has provided us personal information, contact us and we will delete it.

## 9. Health and wellness disclaimer

Cloud Therapy provides general relaxation and breathing exercises for wellness purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. It is not a substitute for professional care. If you are in crisis or need help, contact a qualified professional or your local emergency services.

## 10. Security

We use industry-standard measures to protect your information, including encryption in transit, hashed passwords, and access controls that scope each record to its owner. No method of transmission or storage is 100% secure, so we cannot guarantee absolute security.

We may update this Policy from time to time. We will revise the "Last updated" date above and, for material changes, provide a more prominent notice.

These Terms of Service ("Terms") govern your use of the Cloud Therapy mobile app (the "App"), provided by SOUTH SPHERE TECH PTY LTD ("SouthSphere", "the Company", "we", "us"), a company registered in South Africa. By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

## 1. The service

Cloud Therapy offers short, guided breathing, grounding, and relaxation "resets," progress tracking, reminders, and optional premium features. We may add, change, or remove features over time.

## 2. Eligibility and accounts

- You must be at least 13 years old (or the minimum age required in your country) to use the App.

- You may use the App as a guest or by creating an account (email, Google, or Apple). You are responsible for activity under your account and for keeping your login secure.

- Provide accurate information and keep it up to date.

## 3. Health and wellness disclaimer

Cloud Therapy is provided for general wellness and relaxation only. It is not a medical device and does not provide medical advice, diagnosis, or treatment, and is not a substitute for professional care. Always seek the advice of a qualified health provider with questions about a medical or mental health condition. If you are experiencing a crisis or emergency, contact your local emergency services or a crisis line immediately. You use the exercises at your own discretion and risk.

## 4. Subscriptions, free trial, and payments

- Cloud Therapy offers a free tier and an optional Premium subscription (monthly or annual).

- Premium may be offered with a 7-day free trial. If you do not cancel before the trial ends, it automatically converts to a paid subscription.

- Subscriptions are billed through your Apple App Store account. Payment is charged at confirmation of purchase. Subscriptions auto-renew unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.

- Manage or cancel your subscription anytime in your Apple ID → Subscriptions settings. Deleting the App does not cancel a subscription.

- Prices are shown in the App and may vary by region and change over time; changes will not affect the period you have already paid for.

- Refunds are handled by Apple in accordance with the App Store terms; we do not process payments directly and generally cannot issue refunds ourselves.

## 5. Acceptable use

You agree not to:

- reverse engineer, decompile, or tamper with the App or attempt to circumvent its security, subscription, or entitlement checks;

- access the service through unauthorized means or disrupt its operation;

- use the App unlawfully or infringe others' rights.

## 6. Intellectual property

The App and its content (excluding your own data) are owned by the Company or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes under these Terms.

## 7. Your data

Your use of the App is also governed by our Privacy Policy, which explains what we collect and how we use it. You retain your rights to the personal data you provide; you can delete your account and associated data in Me → Delete account.

## 8. Third-party services

The App relies on third-party services (including Apple, Google, and Supabase). Your use of those services may be subject to their own terms, and we are not responsible for them.

## 9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that data sync will always be complete or timely.

## 10. Limitation of liability

To the fullest extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some may not apply to you.

## 11. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the service. Sections that by their nature should survive (e.g. disclaimers, limitation of liability, intellectual property) will survive termination.

## 12. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, provide a more prominent notice. Continued use after changes take effect means you accept the updated Terms.

## 13. Governing law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-laws rules, and you agree to the non-exclusive jurisdiction of the South African courts.

## 14. Apple-required terms

These Terms are between you and the Company only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide support or handle claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
